I'm just shooting ideas but way I see it this could be a story about the fabric of magic as much as a mystical threat. That's why it I chose these three. Fate is the mightiest mage, Marvel channels the rock of Ages and Alan Scott has the Starheart.
Others would make appearances of course an Zatanna could be a good 4th member.

Well there are loads of lawsuits going on. About the original creators families trying to get the rights for him and if they do, DC can't publish any more Superman.
Also, DC do write some great magical stories. I've got a link of my own of great magical stories.

Except that will never happen, the family won't win. And even if the family did (something that won't happen), it won't be the end of Superman since there's too much money in that. It will just lead to DC renegotiating a contract with the family and then things will be back to the usual. Also, DC do write some great magical stories. Zatanna: Ongoing series. there's a BIG difference between having some good mystic stories and the company knowing shit fuck about using them properly in a large sense. if they did we wouldn't have the sorcerer's paradox or mystics being where they are right now.

As Marvel put it...What if?? the worst thing that could ever happen is for DC to take cues from Marvel especially what if stories... And they already have better: Elseworld and Vertigo. Right now the mystics just like the rest of DC is in an infernal shit hell of bad that it will never completely crawl out of unless it completely restarts EVERYTHING with no regard for previous canon, no link to it in the storyline or intent to take it in the same direction. I dropped DC for a reason. Too much crap, just too much crap.

Ok so tell me something. Johns knows how to use the character perfectly, Morrison too (for the little we've seen), Waid has expressed interest and used him greatly in Kingdom Come, Gail Simone has been begging to get the characters for years. Gerry Ordway isn't doing much these days and says he would like to return. And the writer who gets to handle the family is newcomer Eric Wallace? Come on you gotta be kidding me.... What a world.

I love CM3 as a character but he was waaaaay too underused to take over as Captain Marvel.
He hasn't had an ongoing series (because I'm personally ignoring Trial) since he was part of the Atom's Titans. He was a great guest star for Teen Titans and Young Justice. He was fun. You don't need him to become all solomn and responsible. He's not Captain Whitebread. He's Captain Strongest Kid on the Block.

If you ignore Trials then he became Captain Marvel from nowhere. I did like his guest star in Teen Titans against Doctor Light.

Even if the family was to win the suit, DC still have the trademarks to the names Superman and Man of steel. Plus the trademark to th s symbol. If the family want to make any money at all of the license they will have to deal with DC. The public aren't likely to buy a Superman they don't recognize to the extent of that known. Plus the copy right doesn't last long enough to establish an alternate marketing name ( like Shazam for CM since Marvel already held the trademark on that name)
